WARRANTY STATEMENT PURSUANT TO SECTIONS 443, 479 OF THE GERMAN CIVIL CODE (BGB)

1. In addition to your statutory warranty rights (liability for defects), we grant you a free-of-charge warranty for the products advertised by MANHATTAN. The duration of the warranty depends on the product and can be found for the respective product in Appendix 1 below. The warranty begins at the time the invoice is issued to the customer/buyer within the meaning of Sections 446 and 447 of the German Civil Code (BGB). The warranty applies exclusively to the legal relationship between MANHATTAN and the customer/buyer and not to third parties; it therefore cannot be transferred to third parties.
   
   The territorial scope of our warranty is limited to the Federal Republic of Germany.
2. If a defect occurs in the goods you have purchased during this period, we will provide one of the following services under this warranty, at our discretion:
   • free repair of the goods or
   • free replacement of the goods with an equivalent item

3. In the event of a warranty claim, please contact us as the warrantor

4. Warranty claims are excluded in the event of damage to the goods caused by
   • normal wear and tear or other normal deterioration
   • improper or abusive use
   • operating errors
   • failure to observe any safety precautions or the instructions for use
   • use of force (e.g. impacts)
   • repair attempts carried out by the customer (in particular opening the housing)
   • force majeure or exceptional environmental conditions
5. A prerequisite for making use of the warranty service is that you enable us to examine the warranty claim (e.g. by sending in the goods). For this purpose, the defect must be reported by completing a returns form on the warrantor's website at Manhattan Product Returns and sending the goods to IC Intracom Vertriebs GmbH, Löhbacher Str. 7, 58553 Halver for inspection. Care must be taken to avoid damage to the goods during transport by using secure packaging. A copy of the invoice for the goods must be enclosed when applying for warranty service so that we can verify whether the warranty period has been complied with. In the event of justified warranty claims, you will not incur any shipping costs, i.e. we will reimburse any shipping costs incurred.

Important note: This commercial warranty provided by us does not restrict your statutory rights in the event of defects against us arising from the purchase contract concluded with us, and these rights may be exercised by you free of charge. Any existing statutory warranty rights against us therefore remain unaffected by this warranty promise. This commercial warranty therefore does not infringe your statutory rights, but rather extends your legal position.

6. If the purchased item is defective, you may therefore contact us in any case within the framework of the statutory warranty, irrespective of whether a warranty claim exists or whether this warranty is invoked.
7. The warranty does not cover direct or indirect consequential damage resulting from defects. The warranty claim becomes time-barred after three years in accordance with Section 195 of the German Civil Code (BGB).
